New York man nabbed in Merrimack on credit card, identity fraud
MERRIMACK – A New York man was arrested Wednesday after police say he allegedly attempted to fraudulently purchase alcohol from a Merrimack liquor store.
Police are on the lookout for a second suspect connected to the incident.
Bronx, N.Y., resident Juan Gutierrez, 23, faces one count of identity fraud, a Class A felony, and misdemeanor charges of credit card fraud and resisting arrest.
Officers with the Merrimack Police Department responded Wednesday shortly before 5 p.m. to a report from the state liquor store on Dobson Way of two male subjects attempting to purchase alcohol with possibly stolen credit cards. Police say liquor store staff were tipped off by a nearby business, which said said the suspects had visited earlier.
Court documents filed by Merrimack officer Christopher Dowling state when he arrived at the scene, the other suspect pulled out of the parking lot in a black or dark grey SUV at a high rate of speed. Police now believe that vehicle to be a gray 2017 Hyundai Santa Fe with the New York license plate HKD1979.
Dowling said he notified nearby police, but that they were unable to identify the vehicle.
Police saw Gutierrez at the register, who was wearing attire which met the dispatcher’s description – “a Detroit Lions ballcap and a multi-colored jacket with a ‘B’ on the back,” according to court documents. The cashier then pointed at Gutierrez.
After identifying himself as a police officer, Dowling said he attempted to handcuff Gutierrez, but he resisted. Dowling then reported he “put (Gutierrez) up against the building” and successfully handcuffed him.
Upon searching Gutierrez, Dowling said he found a Pennsylvania driver’s license with the name Jonathan James on it but Gutierrez’s picture, as well as seven Visa and Mastercard debit cards without identification on them.
After running the license number at the station, Dowling said it was registered to a Pennsylvania man with a different name than on the license.
While police were booking Gutierrez, Dowling said they received a call from a Brookline man whose card number was used to purchase $134 of alcohol, the same value reportedly purchased by the other suspect.
Gutierrez entered not guilty pleas to the misdemeanor charges Thursday during his arraignment at a Merrimack District Court. He is currently being held on $10,000 cash-only bail at the county jail in Manchester.
