Assisted-living facility nurse indicted on charges accusing her of breaking resident’s fingers

MANCHESTER — A 65-year-old registered nurse formerly employed at an assisted-living facility is facing three felony charges accusing her of breaking a resident’s fingers while allegedly trying to pry them off of a “call bell,” a device used by people with mobility limitations to summon assistance.

Nancy A. Waller, of 312 Francestown Road, New Boston, was working at the Rose Meadow Farm, 37 Briar Hill Road in New Boston, in December 2020 when she allegedly caused a 59-year-old resident “to suffer serious bodily injury, specifically one or more fractures to his left hand,” by allegedly “prying his fingers off of a call bell,” according to one of the three indictments handed up by the grand jury for the September term of Hillsborough County Superior Court North.

Rose Meadow Farm, according to its website, offers “specialized supported residential programs for individuals with brain injury, spinal cord injury and neurological disorders.”

Two of the indictments charge Waller of abuse of facility patients, and one accuses her of second-degree assault. All are Class B felonies.

Waller is also accused of “willfully (and) harmfully neglecting the resident “by preventing him from being examined by outside medical professionals,” the indictments state.

She is also charged with one count of simple assault, which, because it is a Class A misdemeanor, is considered an “information” count in the indictment process.

New Boston police arrested Waller on April 8. Later that month, she entered into an agreement with the state Board of Nursing to not practice nursing in New Hampshire as her case moves forward in court.

According to Waller’s case summary, a status conference scheduled for last week was canceled and rescheduled for Oct. 25.

If the case goes to trial, a final pretrial conference would take place March 3, 2022, with jury selection set for March 14.
