HUDSON – Although police say neither the driver or his passenger were wearing seatbelts, both escaped with only minor injuries when their small sedan went off Tracy Lane and sheared off a utility pole around midnight Tuesday.

The driver, Louis Pilat, 23, of Hudson, was taken to Southern New Hampshire Medical Center in Nashua for treatment of his injuries, police said, adding that after a brief investigation he was arrested on a driving while intoxicated charge.

The passenger, Cory Smith, 45, of Derry, was taken to Parkland Medical Center for treatment of his injuries, police said.

The airbags in the car did deploy, police added.

Pilat was later booked on the charge and released on personal recognizance bail pending arraignment, which is scheduled for Oct. 9 in Nashua district court.
