Suspect in Nov. 2 downtown stabbing extradited, arraigned, jailed; alleged victim still critical

NASHUA — After spending more than a month in a Rhode Island lockup following his Nov. 4 arrest on a fugitive from justice charge out of Nashua, Kelvin B. Lewis — the suspect in the near-deadly stabbing of a Nashua woman two days earlier — is back in jail in New Hampshire after he finally agreed to waive extradition.

Lewis, 32, whose last known address is 41 Cottage St., Everett, Massachusetts, went before a Superior Court judge Monday for arraignment on the charges stemming from the alleged stabbing.

They include two counts of first-degree assault, Class A felonies, and one count each of criminal threatening — deadly weapon, and criminal restraint, both Class B felonies.

Judge Jacalyn Colburn ordered Lewis be held on preventive detention, and set a dispositional conference for Feb. 16. If the bail order is amended to give Lewis the opportunity to post bail, he would be prohibited from having any contact with the alleged victim and two other people who are believed to be witnesses. He also must stay away from 87 Pine St. and 30 Ledge St., and cannot possess firearms or consume alcohol, according to the order.

Meanwhile, the alleged victim, a 51-year-old Nashua woman, remains in a Boston hospital recovering from what police described as serious stab wounds to the neck and another large laceration to the webbing of her left hand. Bleeding heavily from her mouth and neck, she had difficulty speaking with officers, according to police reports.

She was initially treated at Southern New Hampshire Medical Center, then flown by medical helicopter to a Boston hospital, where her condition remains stable, but critical, police said.

Officers who responded to the call for a reported stabbing at 87 Pine St. late the night of Nov. 2 were told by witnesses that the suspect, along with a female companion, had fled the scene by the time police arrived.

Among the witnesses was the owner of 87 Pine St., who told police he “ran from the residence in fear after (the alleged victim) was stabbed,” the report states. The owner told police he wasn’t sure what triggered the incident, but he thought it had something to do with money.

Present with the owner when the incident occurred were the alleged victim, a 23-year-old woman named Melanie Diperna and, the owner told police, “an unknown male he believed to be Melanie’s boyfriend … .”

The man, whom the owner called “Dave,” was later identified as Lewis, according to police. At some point, Lewis allegedly “began flipping out and demanding money,” and began to tie the owner’s extremities together with a roll of tape, the reports state.

With his arms and legs bound together, the owner watched Lewis allegedly “grab a large kitchen knife … put it to the owner’s throat, telling him he would kill him.”

The owner was able to break free, police said, at which time Lewis allegedly began stabbing the woman.

That’s when the owner fled, and once outside he was able to flag someone down to call police.

The owner and other witnesses referred to DiPerna as Lewis’s girlfriend, the reports state. They allegedly fled the scene together, and two days later they were captured together by Rhode Island state police at the scene of a motor vehicle crash on I-95 in Hopkinton, Rhode Island, a small town in the southwest corner of the state on the Rhode Island-Connecticut border.

While Diperna has three open cases — two of them involving various drug-related offenses in Manchester — currently pending in Hillsborough County Superior Court North, it doesn’t appear she is facing any charges in connection with the Nov. 2 incident.

She is, however, charged in Rhode Island with four offenses that state police filed when she and Lewis were arrested in that state.

They include:

* Fugitive from justice out of New Hampshire — Hillsborough County Superior Court warrant for failure to appear in court for possession of fentanyl, possession of Buprenorphine, dealing in or possession prescription drugs, and receiving stolen property

* Possession of a stolen motor vehicle

* Breaking and entering of a dwelling when resident on premises

* Obstruction of officer in execution of duty.

As for Lewis, the Rhode Island charges he faces include:

* Fugitive from justice out of New Hampshire — first-degree felony assault (the alleged stabbing)

* Possession of stolen motor vehicle

* Two counts of simple assault

* Assault with intent to commit specified felonies

* Attempted robbery (car-jacking)

* Breaking and entering of a dwelling when resident on premises

* Obstruction of officer in execution of duty.

Meanwhile, Nashua police are asking anyone who may have more information about the Nov. 2 incident to contact the department at 594-3500, or call its Crime Line, 589-1665.
