Teeboom files new spending cap complaint in court

NASHUA – A structuring conference has been scheduled for July 21 in former alderman Fred S. Teeboom’s latest suit against the city, which he filed a week ago in Hillsborough County Superior Court South.

Teeboom, a key author of the city’s spending cap, which was adopted by citizen referendum nearly 30 years ago, is petitioning the court to issue a writ of mandamus, which means he is asking the judge to direct a public authority – in this case, city officials – to perform certain legal duties that Teeboom alleges they have not performed.

Teeboom names as defendants the city of Nashua, city corporation counsel Steve Bolton, and chief financial officer John Griffin.

Teeboom, in a sttatement, blamed the administration of Mayor Jim Donchess for “promptly attempting to eviscerate the cap” when he took office in 2016. He indicated he filed the petition in response to “the city’s latest attempt … to manipulate and corrupt the spending cap” in crafting its fiscal 2023 operating budget.

Teeboom claims that the budget is $8.5 million above the cap, but it has allegedly been misrepresented as being $113.3 million below the cap.

The July 21 hearing, meanwhile, is scheduled as a telephonic structuring conference.
