Accused non-compliant sex offender nabbed in Nashua

NASHUA — Roughly two months after he was featured as the U.S. Marshals Services Fugitive of the Week, Nashua resident Robert J. Cain was taken into custody, a result that both federal and local authorities said was made possible by the numerous tips they received from the public.

Cain, who has two dates of birth on file — one that makes him 59 and another that makes him 54 — was charged upon his arrest with three counts of duty to report, subsequent offense, which are Class A felonies.

He is accused of failing to comply with the terms of the order requiring him to register for life as a Tier II sex offender, which include notifying law enforcement of any changes in his status, such as an address change and several other categories.

Cain, who was booked on the charges and refused bail, is due back in Hillsborough County Superior Court South June 22 for a dispositional conference.

Whether the court set bail following Cain’s arraignment isn’t known.

The requirement that Cain register as a sex offender stems from a 1987 case in which he was convicted in a Peabody, Massachusetts court of assault and battery on a child, according to Nashua police and the U.S. Marshalls office.

Cain is believed to have left the area for an unknown destination sometime before the end of 2021. Police said detectives with the Special Investigations Division and members of the New Hampshire U.S. Marshals Service began looking for him in January, and shortly thereafter learned he had departed the area.

Come mid-February, the Marshals Service chose Cain as their fugitive of the week, distributing information, photos and posters to news media throughout the state.

It didn’t take long before tips were rolling in, some of which initially pointed law enforcement personnel toward Manchester before others came in directing them back toward Nashua.

Within 24 hours, according to Jeffrey White, spokesman for the U.S. Marshals Service New Hampshire district, “an alert Nashua officer observed Cain on Harbor Avenue in the area of McDonald’s,” where he and other officers took Cain into custody without incident.

Nashua police said they urge anyone who may have additional information on this case, or has information on non-compliant sex offenders that they would like to report anonymously, can do so by calling the department’s Crime Line at 589-1665.
