Indictments handed up in connection with July 2018 murder of Nashua resident David Smith

NASHUA — The Hillsborough County Superior Court South grand jury for March has indicted a 30-year-old Connecticut man by the name of Clinton Turner on charges connected to the summertime 2018 murder of Nashua resident David A. Smith.

The arrest and indictment of Turner, formerly of New Haven, appears to be the closest investigators are going to get to the gunman who shot and killed Smith — Tramaine Poole, also of New Haven — because he’s also deceased, having been shot and killed during a shootout with officers in Sussex County, Virginia, on Aug. 1, 2018 — just three weeks after Poole killed Smith.

Now, according to a joint statement by the office of Attorney General John Formella and Nashua police Chief Kevin Rourke, Turner is currently being held without bail on separate charges awaiting a date for his arraignment in Hillsborough County Superior Court South.

The indictments charge Turner with:

* One count of accomplice to second-degree murder, for allegedly “aiding or acting in concert with Tramaine Poole and others to rob David Smith with a deadly weapon and helping to recklessly cause David Smith’s death with extreme indifference to the value of human life when Tramaine Poole shot David Smith in the head”

* Two counts of robbery, for allegedly “using physical force against David Smith while (Turner) was aiding or acting in concert with Tramaine Poole and others to commit a theft from David Smith with a deadly weapon when David Smith was aware of such force, and when Tramaine Poole was armed with a handgun; and also when Tramaine Poole inflicted death upon David Smith by shooting him”

* One count of conspiracy to commit robbery, for allegedly “agreeing with Tramaine Poole and others to rob David Smith, and then at least one of twelve separately alleged overt acts which occurred in furtherance of their conspiracy.”

Also indicted in connection with Smith’s death was Diana Hazard, 32, address unknown, for allegedly being an accomplice to the robbery of Smith.

Two “information counts” — misdemeanor-level offenses — were also filed against Hazard, accusing her of theft, and conspiracy to commit theft, of Smith and his property.

As for Poole, an active arrest warrant was pending out of New Haven at the time of Smith’s murder, according to the statement. Poole was wanted for the murder in New Haven of Tyequa Nesbitt, 28, at the time.

Officials said that on the day Poole was killed, he was fleeing from Virginia state police officers in a stolen vehicle, and was firing a handgun at pursuing officers.

Back in Nashua, it was just after midnight on July 8, 2018, when police responded to a 911 call from 19 Buck St. The caller, described as a roommate of Smith’s, arrived home to find Smith unresponsive and “cold to the touch,” according to reports at the time.

Smith was pronounced deceased, and his body was transported to the state Medical Examiner’s office for an autopsy.

Chief Medical Examiner Jenny Duval, who conducted the autopsy, ruled Smith’s death a homicide, and determined he was killed by a single gunshot wound.

Few people living in the area knew Smith, but at the time of the murder, Mark Carter, whose Ash Street apartment is on the corner two doors down from Smith’s building, called Smith “a wonderful man,” and said he hopes the case is solved soon.
