September court date set for Nashua man accused of exposing himself, making lewd gestures in Greeley Park

NASHUA – The 67-year-old man charged with indecent exposure – lewdness for allegedly exposing himself and engaging in lewd behavior in Greeley Park has been arraigned and is awaiting his next court date.

Donald R. Lemay, of 165 Pine St., is now scheduled for a dispositional conference at 8 a.m. Sept. 23 in Hillsborough County Superior Court South, according to his case file.

The charge is typically a misdemeanor offense, but police upgraded it to a Class B felony after discovering that Lemay was convicted of “an equivalent offense” in Fitchburg, Massachusetts some years ago.

Police who responded to Greeley Park to check on a report of a man, clad in black underwear, had allegedly pulled the underwear down, exposing his genitalia, while allegedly “pleasuring himself” in the presence of another person, according to police reports.

At one point, according to the reports, the suspect, later identified as Lemay, allegedly gestured toward his mouth “as if to simulate, or suggest, oral sex.”

Told by at least one witness to leave the park, Lemay reportedly got into a dark-colored minivan and drove off.

A short time later, an officer on patrol spotted a vehicle on Water Street that matched the description of the suspect vehicle and pulled it over, police said.

The driver, whom the officer identified as Lemay and noted that he matched the description of the suspect, allegedly told the officer he had been at Greeley Park, but he “denied interacting with anyone” when he was there, the reports state.

Lemay, police said, told detectives he was using a portable toilet at the park, but also said he urinated in the woods. He also denied “pleasuring himself,” police wrote.

Upon request, police said, Lemay showed detectives his underwear, which was black. He also allegedly told detectives he had “male pornography” in his van, although he refused to allow police to search the vehicle.

Lemay was taken into custody and transported to police headquarters for booking. He was initially ordered held on preventive detention, but it’s unclear if bail was later set, and if so, whether Lemay posted bail.
