Nashua man facing multiple charges alleging he punched, slapped, raped and whipped with a belt his longtime girlfriend

NASHUA – When Nashua police arrested Walnut Street resident Jency Diaz just after midnight Saturday for allegedly striking his girlfriend and smashing her phone, they booked him on the charges then released him on bail – on the condition he stay away from her and commit no crimes.

About two hours later, according to police reports, Diaz’s mother, who lives elsewhere in town, arrived at police headquarters to pick up her son.

Diaz, using his mother’s phone, according to police, allegedly sent his girlfriend more than 20 text messages in a span of six minutes just before 4 a.m.

Police said that a short time later, Diaz got out of his mother’s car in the area of Kinsley and Elm streets, and allegedly headed back to 89 Walnut St., Apt. 2, his and his girlfriend’s residence.

By 5 a.m., police reports state, Diaz was back in police custody, not only for violating both conditions of his bail, but also on additional charges including domestic violence-related aggravated felonious sexual assault, a special felony, and second-degree assault – domestic violence, a Class B felony.

Police also charged Diaz with three Class A misdemeanors: Breach of bail, criminal mischief and stalking – domestic violence.

This time, the judge ordered Diaz held without bail as his case proceeds in Hillsborough County Superior Court South. His next court date is not yet listed in his case summary.

Meanwhile, it was the alleged victim’s mother who alerted police that Diaz had allegedly returned to the apartment, according to police.

The mother, who lives in another city, called Nashua police around 5 a.m. asking them to check on the well-being of her daughter.

She said she had received “several missed calls” from her daughter, and was apparently unable to reach her.

When officers arrived, Diaz wasn’t there, according to their reports. But the alleged victim was, and the officers immediately “observed extensive injuries throughout the entirety of her body,” the reports state.

She had numerous welts on her arms and legs, bruising and swelling to both sides of her face, a bruised nose and “partial black eyes,” police said.

She was transported to a local hospital, where, police said, medical personnel confirmed she had a fractured nasal bone.

Police promptly issued a warrant for Diaz’s arrest, and several hours later they located him and took him into custody.

In the meantime, the police department’s Crime Scene Unit was called in to process the scene and collect evidence and to interview the alleged victim.

She told officers that after Diaz allegedly smashed her phone, he grabbed her by the hair, dragged her into the bedroom and onto the bed, where he allegedly sat on her and “punched her about 10 times with his fists, head-butted her, slapped her five times,” then allegedly “whipped her with a belt about 20 times,” the reports state.

She told police that when she rebuffed Diaz’s demand to engage in sexual intercourse, he allegedly whipped her with the belt again and used a vulgar term to claim ownership of her body before allegedly pulling off her shorts.

Suddenly, the alleged victim told police, Diaz “had a swing of emotions,” and began to cry and apologize to her.

Diaz, in a post-arrest interview with detectives, admitted to most of the allegations made against him, telling them that “he consumed Xanax and alcohol, which caused him to be a different person – and he was apologetic for his actions.”
