Brookline police charge 76-year-old convicted sex offender with failing to report new information

BROOKLINE – When a Superior Court judge accepted a plea deal two years ago in which longtime Brookline resident Gerard J. Michaud agreed to plead guilty to two of the 18 sex-assault charges against him in exchange for suspended jail time, the sentencing order contained provisions that Michaud register as a Tier II sex offender.

But in September, according to a Brookline police officer’s report, Michaud allegedly violated a stipulation in the order when, police said, he registered a motor vehicle without notifying police within five days.

The charge – “change of registration information: duty to inform” – is a Class B felony, which carries a penalty of up to 3 1/2-7 years in prison and a $4,000 fine.

In his report, police Officer Nick Lavoie wrote that he became aware on Sept. 14 that Michaud allegedly “had yet to notify Brookline police in writing of the new information regarding his vehicle.”

Lavoie wrote that Michaud registered the vehicle on Aug. 28, and more than two weeks had passed by the time Lavoie learned Michaud had allegedly not reported the information to police.

The stipulation that required Michaud to tell police he registered a newly purchased vehicle is one of several that defendants who are deemed sex offenders by the court must abide by. As a Tier II sex offender, Michaud is considered a “moderate” risk to the public. Tier I offenders are considered low risk, while Tier III offenders are considered a high risk.

As for Michaud’s sex-assault case, he was indicted in late summer 2017 on 18 misdemeanor charges – nine counts of sexual assault and nine counts of simple assault.

The charges stemmed from the repeated sexual assaults Michaud was accused of committing against a young man who at the time was renting a room from Michaud in his 40 Main St. home in Brookline.

The plea agreement was reached roughly a year later, and in late September 2018 Superior Court Judge Jacalyn Colburn accepted the deal at a hearing attended by the victim.

According to the terms of the agreement, Michaud was sentenced to two, 12-month terms in jail, all suspended for five years on the condition of good behavior, and that Michaud have no contact with the victim and that he register as a Tier II sex offender.

The registration requirement was actually a continuation of Michaud’s presence on the state’s sex offender registry: He has been listed on the registry since he was convicted of felonious sexual assault in December 1988.

In addition to that conviction, and the ones in September 2018, Michaud has two additional convictions on his record: One for duty to report in October 2014 and one for fraudulent use of a credit card in July 2008, according to his criminal history.

Meanwhile, the case stemming from Michaud’s most recent arrest in September is moving forward in Hillsborough County Superior Court South in Nashua.
