Jacob Cherico, 22, of 40 Marsh Road, Hudson

NASHUA – A Superior Court judge Thursday sentenced Jacob Cherico, the Hudson man accused of threatening to kill another man in February over a girlfriend dispute, to time served and a deferred jail sentence on the condition he submits to a mental health evaluation and gets drug and alcohol treatment.

Cherico, 22, of 40 Marsh Road, was also charged with ramming the other man’s truck as they drove on Derry Road, acts that police said apparently stemmed from the alleged victim’s sexual relationship with Cherico’s girlfriend.

According to the plea agreement accepted Thursday in Superior Court, Cherico agreed to plead guilty to one count of reckless conduct – deadly weapon, which had been reduced from a felony to a Class A misdemeanor, and to one count of criminal threatening, also a Class A misdemeanor.

A second count of reckless conduct – deadly weapon – was dropped as part of the agreement.

Cherico was sentenced to 75 days in jail, stand committed, with credit for 75 days of time served, which cancels out jail time.

On the criminal threatening count, Cherico was sentenced to 12 months in jail, deferred for one year and then suspended for three years. Conditions include drug and alcohol counseling, and that he have no contact with the other man or the woman.

Cherico is also prohibited from possessing any firearms for three years.

The incident that led to Cherico’s arrest occurred the evening of Feb. 23, when, police said at the time, Cherico reportedly tried to run the other man’s pickup truck off Derry Road near Tracy Lane.

The other man, who lives around the corner from Cherico, told police he is familiar with the Cherico family’s vehicles, and was able to identify Cherico as the driver of the red Ford pickup that allegedly rammed his vehicle and “attempted to push it off the road,” according to police reports.

Police said Cherico then fired two rounds from a handgun in the direction of the other man’s truck. A short time later, police said, Cherico contacted the man by phone and allegedly warned, “next time, I’ll aim for your head,” police reports state.

Nobody was injured in the incident. Cherico was arrested and taken into custody without incident, police said.
