Man sentenced to prison on probation violation charge

NASHUA – Sentenced on drug charges about 13 months ago to 2-4 years in prison, all suspended on certain conditions that included two years of probation, Nashua resident Korey Brown on Wednesday pleaded true to violating that probation, resulting in a 1 1/2 – 4 year stand-committed sentence.

The plea agreement gives Brown, 26, most recently of 7 Eric Ave., the opportunity to have some of that minimum sentence suspended, by participating in, and successfully completing, the State Prison’s Focus program, according to his sentencing order.

The original charge – one count of possession of a controlled drug, subsequent offense – stemmed from Brown’s arrest in late 2018. In March 2019 he pleaded guilty as part of a plea deal, and was sentenced to 2-4 years in prison, all suspended for two years on the condition he participate in a substance use disorder treatment program and provide proof of compliance.

He was also ordered to perform 25 hours of community service.

But in August 2019, according to his case summary, a warrant was issued for Brown’s arrest on allegations he violated terms of his probation.

He was arrested in October, and ordered held in jail as the case proceeded. A plea and sentencing was scheduled for March 31, but it was continued, and took place Wednesday via video conference.

Superior Court Judge Charles Temple accepted the agreement, which also grants Brown credit for the 169 days he’s spent in jail, bringing his minimum sentence to just over one year.

The agreement also calls for Brown’s probation to be terminated, and orders him to remain on good behavior.
