Local woman opts for jury trial

NASHUA – Charged in April with a misdemeanor count of resisting arrest, former Merrimack resident Julie Tomchak entered a not-guilty plea in Merrimack district court, but was later found guilty.

Tomchak, 44, who also goes by Julie Baxter, was sentenced to seven days in jail, all suspended for one year on the condition of good behavior.

But the case wasn’t finished: At some point after Tomchak was sentenced, she appealed the guilty finding, setting the stage for a jury trial in Hillsborough County Superior Court-South.

On Monday, jurors were selected and seated for Tomchak’s trial, which is scheduled to begin Wednesday or Thursday in the Nashua court.

According to documents in her file, Tomchak, who for a time lived in Merrimack, is currently living in a tiny Idaho town called Leadore – population around 100 – situated in far eastern Idaho along the Montana border.

The resisting arrest charge, meanwhile, stemmed from an incident on April 25, in which police said Tomchak allegedly interfered with a police officer by “driving away from him” after the officer told her “she was not free to leave,” according to the reports.

When the officer told her not to leave, the reports state, Tomchak allegedly told him “he would need to shoot her to stop her.”

Superior Court Judge Jacalyn Colburn is scheduled to preside over the trial, which isn’t likely to take much more than a day.
