NASHUA – As police tried to take him into custody on Dec. 4, Ronald Duby, the Nashua man with an extensive history of failing to update his sex offender registry status, “threatened suicide” by allegedly “taking various medications and swallowing numerous needles,” according to police reports.

Duby, 46, was subsequently transported to a local hospital, where police said he was sedated, intubated and admitted to the intensive care unit.

But when he recovered two days later, Duby appeared in Hillsborough County Superior Court-South for arraignment and a bail hearing on his most recent set of charges: Two counts of registration of online identifiers, Class A felonies; two counts of resisting arrest or detention, Class A misdemeanors; and one count of violation of parole, stemming from an outstanding arrest warrant.

Judge Charles Temple ordered Duby housed on preventive detention, citing Duby’s “extensive criminal history, the facts and circumstances of his Dec. 4 arrest, and his suicidal ideations and self-destructive behavior,” according to the bail order.

Temple stated in the order that the court will reconsider Duby’s bail if he is released “with an associated parole plan” in place.

As a Tier III sex offender, Duby is required to update his sex offender registry information every three months, according to police. That order has been in place since March 13, 1995, when Duby was convicted of two counts of felonious sexual assault – victim under age 16, and one felony count of lewd/lascivious conduct with a child, police said.

Those cases were litigated in Windsor County, Vermont district court.

As for last week’s arrest, police said detectives spoke with Duby in June about updating his sex offender information. He allegedly told them he was considering creating a Facebook account, but, according to police, he said he would notify police if he did so.

When police learned in October that Duby allegedly created an account without notifying them, he allegedly told them he created the account so he could contact his father.

On Nov. 4, with members of the department’s Special Investigations Division now involved, police issued a warrant for Duby’s arrest, according to the reports.

After looking for Duby for nearly a month, police tracked him down at 30 Chestnut St. on the evening of Dec. 4.

When officers approached the residence and announced to Duby that he was under arrest, Duby allegedly “retreated” to a bedroom, which, police said, triggered “an extensive negotiation process.”

When Duby finally emerged from the bedroom, police said, he allegedly refused to show his hands, as ordered, prompting police to release the K-9 they brought to the scene.

According to the reports, Duby resisted officers’ attempts to take him into custody, during which he allegedly took the medications and swallowed the needles, while threatening suicide.

Duby is next due in court on Feb. 11 for a dispositional conference.
