N.Y. couple among those indicted
Duo accused of stealing $30K from elderly Nashua man
NASHUA – Six months after a former longtime Hollis resident and U.S. Army veteran died at age 86, a New York State couple known to the man has been indicted on charges accusing them of taking advantage of his “impaired abilities” to steal thousands of dollars from him, according to the state Attorney General’s office.
Kile A. Madsen, 52, and Debra Madsen, 50, currently of Potsdam, N.Y., allegedly agreed on a scheme to transfer a total of $31,000 from the man’s investment account over the course of nine months, between December 2015 and August 2016.
The transfer allegedly gave the couple access to the funds, which, according to the indictments, they spent “at various casinos” over that period of time.
Kile and Debra Madsen each face one count of theft by unauthorized taking and one count of conspiracy to commit theft by unauthorized taking. Both are Class A felonies.
The indictments were among those handed up late last week by the grand jury for the October term of Hillsborough County Superior Court South.
An indictment is not an indication, or proof of, guilt, but represents the Grand Jury’s determination that enough evidence exists for prosecutors to move the case forward in Superior Court.
The alleged thefts, according to the indictments, occurred in Hollis “and in other locations in southern Hillsborough County,” and were conducted “with the purpose to deprive” the elderly man of funds.
They also accuse the Madsens of “intending to take advantage of (the alleged victim’s) age, or physical or mental condition, that impaired his ability to manage his property or his financial resources … .”
Other indictments the October grand jury handed up include two that accuse a Pembroke man with sexually molesting a 12-year-old girl in Nashua some 20 years ago.
Robert E. Pratt, 58, faces two counts of aggravated felonious sexual assault involving a victim under age 13. Pratt allegedly engaged in sexual acts with the girl between Christmas 1997 and Christmas Eve 1998. Both charges are Class A felonies.
The grand jury also handed up indictments for the following suspects:
Nicholas Messina, 27, of 51 Summer St., Apt. A, Haverhill, Mass. Three counts, possession of a controlled drug with intent to distribute, special felonies; one count each, felonious use of a firearm, and felon in possession of a dangerous weapon, Class B felonies, for allegedly possessing marijuana, cocaine and fentanyl with the intent to distribute; possessing a firearm while conducting a felony crime, and possessing a firearm after being convicted of a felony offense, on Aug. 1 in Nashua.
Anthony Araujo, 25, of 325 South Melrose Drive, Vista, Cal. Two counts, theft, amount in excess of $1,501, Class A felonies; one count, theft, amount less than $1,000, Class A misdemeanor, for allegedly taking from a Nashua retail store an iMac computer worth about $1,800 and two Apple iMac devices valued at about $3,300, without paying for them, and for taking six pairs of underwear valued at roughly $80 from another store without paying for them, on March 5 and 7 in Nashua.
Brian Clegg, 31, of 69 Lowell Road, Hudson. Two counts, aggravated felonious sexual assault – domestic violence, special felonies; one count, second-degree assault – strangulation, Class B felony, for allegedly engaging in sexual acts with a female by using physical force, violence or superior physical strength to overcome her, and strangling a female intimate partner, between July 1-11 in Nashua.
Allison DeJesus, 32, of 11 Pepperell Circle, Apt. B, Nashua. Three counts, possession of a controlled drug, subsequent offense, special felonies, for allegedly possessing with the intent to distribute methamphetamine, and possessing Buprenorphine and LSD, after having been convicted of a drug-related offense; on Aug. 16 in Nashua.
Bryan Anziani, 18 Cross St., Apt. 2, Nashua. Two counts, aggravated felonious sexual assault, special felonies, for allegedly engaging in sexual acts with a female through the applicaton of physical force and strength, on May 11 in Nashua.
Daniel Anspaugh, 22, of 6 Gorman Ave., Nashua. One count, burglary, Class B felony, for allegedly entering the Hudson Speedway while it was closed, with the purpose to commit theft, and taking trophies and soda, between Feb. 23-26, 2014, in Hudson.
Noah Cosby, 32, 19 Jaffrey Road, Marlborough. One count, insurance fraud, Class A felony, for allegedly presenting false information to his insurance company when he knowingly reported that an accident involving his car occurred after he added the car to his policy, when the accident actually occurred before he added the car to the policy, resulting in the insurance company to pay him roughly $4,300 in damages to which he wasn’t entitled, on April 18, 2017, in Temple.
Mark E. Leach, 59, of 70 Old Derry Road, Hudson. One count each, identity fraud – pose as another, and credit card fraud, Class A felonies, for allegedly posing as another person to defraud a bank by obtaining that person’s account number, and for using that person’s credit card without permission to obtain more than $1,500 worth of electrical supplies from a store, between May 10 and June 18 and on May 25, in Hudson.
