NASHUA – David Philbrick, 47, of Nashua, was taken into custody on June 15 for an alleged repeat offense of fentanyl possession.

According to the Nashua Police Department, officers were following up on complaints about individuals using illegal drugs in the portable restrooms outside of the Nashua Public Library.

Police allegedly observed Philbrick approach one of the portable restrooms and speak with another individual. Officers made contact with Philbrick and placed him under arrest after a brief conversation.

He has been charged with acts prohibited: possession of a controlled drug (fentanyl); subsequent offense.

Philbrick was released on personal recognizance and is scheduled to be arraigned in Nashua District Court on July 16.

Under state law, if convicted, he could face up to 15 years in prison, up to five years of probation and a fine of up to $4,000.
