Indictments on welfare, ID fraud; Nashua couple allegedly said they lived apart, getting $1K

By Staff | Nov 21, 2016

NASHUA – Charges stemming from recent arrests ranging from welfare fraud and identity fraud to drug offenses and knife attacks have led to indictments handed down by the grand jury for Hillsborough County Superior Court southern district in Nashua this month.

An indictment is not an indication or proof of guilt, but represents the grand jury’s determination that enough evidence exists for prosecutors to move the case forward in Superior Court.

A man and two women from Nashua were each indicted on welfare fraud, the result of their recent arrests for allegedly lying to state officials in order to obtain benefits and illegally selling or transferring benefits to each other.

And a New Jersey man had four felony indictments and four misdemeanor "information" charges handed down against him, allegedly for posing as another man, obtaining other people’s information and manufacturing or possessing fake government identification cards, according to the charges.

Charged in the welfare fraud case were Nashua residents Donald Mayfield Jr., 34, and Amy Laponsee Mayfield, 30, both of 81 Anvil Drive, and Evelyn D. Mallette, 33, last known address of 9 Pleasant St.

Amy Mayfield faces three counts of welfare fraud, two of which are Class A felonies and the other a Class B felony, for allegedly making false statements to state officials that her husband, Donald Mayfield, was not living with her, which resulted in her obtaining more than $1,000 in benefits to which she was not entitled; and for allegedly using Evelyn Mallette’s EBT card and her food stamp benefits on numerous occasions between 2011 and 2014.

Donald Mayfield was indicted on one count of welfare fraud, a Class A felony, for allegedly lying to state DHHS officials by telling them he lived alone, in order to obtain more than $1,000 in benefits to which he wasn’t entitled, between January and August 2012.

And Mallette is also charged with Class A felony welfare fraud, which alleges that between January and March 2014, she knowingly transferred or sold food stamps, which led to other people using her EBT card and food stamp benefits to purchase items.

Meanwhile, the New Jersey man, Gendersso Javier, of Camden, was indicted on three counts of identity fraud – obtaining personal information, and one count of identity fraud – posing as another, all Class A felonies; and four counts of possessing or manufacturing a false government identification, Class A misdemeanors, for allegedly stealing other people’s information and posing as them, attempting to obtain cellphones using another person’s identity, and possessing false ID cards, all on Aug. 10 in Milford.

Other indictments handed down this month include:

Carley Williams, 31, 6 Nevada St., Nashua. One count each, first-degree assault – deadly weapon and first-degree assault – domestic violence, Class A felonies; one count each, second-degree assault – deadly weapon, bodily injury; and second-degree assault – domestic violence, Class B felonies; and two counts, endangering the welfare of a child, Class A misdemeanors, for allegedly knowingly, and recklessly, causing bodily injury to a male household member by swinging a knife at him, resulting in a laceration to his head, and for allegedly driving a car containing two children while she was intoxicated, all on Sept. 11 in Nashua.

Melissa Kimball, 27, of 507 Broad St., Apt. 39, Nashua. Three counts, sale of a controlled drug, second offense; and three counts, sale of a counterfeit drug, second offense, all special felonies, for allegedly selling fentanyl to a confidential police informant and selling a substance represented to be heroin, but was not, in December 2015 and January 2016 in Nashua.
