Grand jury issues indictments

NASHUA – A grand jury has handed down more than two dozen felony indictments and nearly 20 more misdemeanor "information" counts that charge a former Nashua man with raping, beating, kidnapping, threatening and terrorizing an ex-girlfriend throughout the summer.

Anthony Martinez, 23, formerly of 27 Elm St. Apt. C, is currently held at the Valley Street jail in Manchester. He was arrested Aug. 30 on charges that allege "a very frightening case of ongoing abuse," a police prosecutor said at the time.

The stack of indictments and information counts against Martinez add up to 45 separate charges, which were among those handed down by the December term of the Hillsborough County Grand Jury.

An indictment is not a finding or indication of guilt, but represents the Grand Jury’s determination that enough evidence exists for prosecutors to move cases forward in Superior Court.

Other indictments of note handed down for December include:

  • Ryan April, 34, 8 Highland Court, Wilton. Four counts, simple assault; one count each, sexual assault and false imprisonment, all Class A misdemeanors, stemming from allegations he sexually assaulted a 20-year-old female, pulled up her shirt, stomped on her foot, knocked her over, sat on her to prevent her from leaving and pushed her to the ground. Police allege the incident took place on July 27 in Wilton.

  • Walter Barbeau, 38, last known address of 70 Talent Road, Litchfield. Three counts, second degree assault, Class B felonies, for allegedly strangling, lifting off the ground, and causing serious injury to a female victim by throwing her against a wall, causing a borken scapula, on Sept. 19-20 in Litchfield.

  • Denise Bergeron, 63, 101 Old Gage Hill Road, Pelham. Two counts, unemployment compensation fraud; one count, theft by deception, all Class A felonies, for allegedly falsifying unemployment compensation reports in order to receive compensation while continuing to be employed, between June 2009 and May 2011 in Hillsborough County.

  • Joshua Hansen, 40, Valley Street jail, Manchester. One count each, armed robbery and robbery, Class A felonies, for allegedly brandishing a knife and threatening and using physical force to steal roughly $50 from a male victim, Oct. 24 in Nashua.

  • James N. Karos, 48, 50 Anvil Drive, Nashua. Four counts, sale of a controlled drug, subsequent offense; two counts, possession of a controlled drug, subsequent offense; one count, possession of controlled drug with intent to sell, subsequent offense, all unclassified felonies, for allegedly possessing and selling heroin and other controlled drugs, Sept. 2, 3, 4 and 15 in Nashua.

  • Waldy Pena, 20, 26 Edwards St., Nashua. One count, robbery, Class B felony, for allegedly threatening a teller at Santander Bank, Nashua, by handing her a note reading "act normal, give me all 100s, 50s and 20s … no dye pack. Don’t be a hero," on Oct. 2 in Nashua.

  • Deanna McIntyre, 38, 623 South Main St., Nashua. One count, welfare fraud, Class A. felony, for allegedly "intentionally failing to disclose her income from the Lowell Sun" resulting in McIntyre receiving "in excess of $1,000" worth of "food stamps, medical assistance and qualified Medicare beneficiary benefits to which she was not entitled," between March 2013 and September 2014 in Nashua.

  • Dahelak Manna, 32, last known address Valley Street jail, Manchester. Four counts, aggravated felonious sexual assault, extended term felonies, for allegedly engaging in sexual contact with a female victim "at a time she was physically helpless to resist by way of intoxication" and after the victim "indicated by speech or conduct" that she was not consenting and "not freely participating in the act," March 12-13 in Nashua.

As for Martinez, the indictments include 12 counts of aggravated felonious sexual assault-domestic violence, unclassified felonies; and three counts of kidnapping-domestic violence and two counts of first-degree assault-domestic violence, all Class A felonies.

Also, five counts of strangulation-domestic violence; two counts of domestic violence; and one count each of second-degree assault-domestic violence and criminal restraint-domestic violence, all Class B felonies.

The "information" charges, all Class A misdemeanors, include seven counts of simple assault-domestic violence; seven counts of domestic violence; three counts of criminal threateneing-domestic violence; and one count each of criminal trespass-domestic violence and obstructing the report of a crime.

The charges stem from a prolonged period of alleged abuse that, according to the indictments, ran from May 21 to Aug. 28 and involved a then-17-year-old girl who had been living with Martinez. He is accused of repeatedly assaulting her over the summer, forcing her to have sex and threatening to kill her if she ever told anyone, court documents state.

The victim, now 18, fled the apartment on Aug. 28 and ran to her mother’s house, but Martinez soon showed up and grabbed the phone from a boy who was trying to call police. Martinez allegedly told the victim that if he was arrested he would "pay bail and I will kill you." Police were eventually called and Martinez was apprehended.
