Local teen accused of sexually assaulting 2

NASHUA – A roughly month-long police investigation into two young girls’ allegations that 19-year-old Daniel Montminy sexually assaulted them in their Nashua home culminated in Montminy’s arrest during the weekend.

Montminy, who turns 20 later this week, is charged with two counts of aggravated felonious sexual assault, which accuse him of committing sex acts upon the girls, ages 15 and 7, including sexual intercourse with the older girl, according to the charging documents Assistant County Attorney Brett Harpster read at Montminy’s Superior Court bail hearing Monday.

Harpster, while acknowledging Montminy has no criminal history and has the full support of his family – five members of which were in court Monday – asked Judge Charles Temple to jail Montminy on preventive detention.

But Temple, after hearing from Harpster and attorney Michael Davidow, who represented Montminy Monday, ordered Montminy released on personal recognizance bail, with the condition of home confinement and that he seek mental health treatment within 24 hours of his release.

The home confinement order requires Montminy to live at the Hudson home of a friend, and not leave the home except to go to work, to court or other legal meetings, or to medical and mental health-related appointments.

Montminy is also ordered to have no contact with the alleged victims, and to stay at least 100 yards away from them. He also must have no contact with any females under age 16.

A status hearing is scheduled for Sept. 19 in the Nashua court.

Davidow, in asking Temple for personal recognizance bail, said his client “needs to get his head together before he can deal with this,” referring to a case that “no matter how it turns out, is very tragic,” Davidow said.

Montminy, a slim young man with bushy hair, remained expressionless for most of the hearing, staring straight ahead and turning only to speak with Davidow.

He poses no danger to the community, Davidow said of Montminy, nor does he present a flight risk.

“He has a place to live … counseling would be appropriate,” Davidow told Temple.

Davidow also said Montminy’s father believes his son’s confession to police was coerced, and suggested they “took advantage of his (young) age.”

Harpster, meanwhile, told the court the older girl came forward in mid-June with allegations Montminy sexually assaulted her. The younger girl, he said, allegedly awoke to him molesting her.

Neither attorney specified whether Montminy allegedly assaulted the girls on more than one occasion, or gave a time frame during which they allegedly occurred.
