Nashua man to enter Adult Drug Court after agreement is reached

By Dean Shalhoup - Senior Staff Writer | Jan 24, 2020

NASHUA – A plea deal featuring a combination of guilty pleas, suspended sentences and dismissed charges has paved the way for a Nashua man to enter Adult Drug Court.

Richard Gurley, 24, last known address of 48 Chestnut St., Apt. A, reached the agreement this week with prosecutors, settling the charges in his two pending cases, one originating in Hillsborough County Superior Court-South and the other from Superior Court-North in Manchester.

In the North case, Gurley entered a guilty plea to one count of possession of heroin, on which he was arrested in October 2018 and indicted in January 2019.

In exchange for the guilty plea, Gurley was sentenced to three to six years in State Prison, all suspended for five years, followed by a three-year probationary period.

He is ordered to participate in any recommended treatment or counseling, specifically that he “meaningfully participate in, and successfully complete,” the Hillsborough County South Adult Drug Court program.

Per the agreement, Gurley also entered a guilty plea to one count of theft by unauthorized taking – third offense, which stemmed from his arrest in December 2018.

He was sentenced to a second State Prison term of three to six years, all suspended for five years, to be served concurrently with the other sentence. If Gurley’s bail is revoked and he is sent to prison, he will be credited with 83 days for time already served, according to the agreement.

As part of the deal, two other drug possession charges, along with one count of stalking – subsequent offense, were dismissed by prosecutors.
