Two indicted on unrelated child sex charges

MANCHESTER – A grand jury has indicted Amherst resident Richard Avery on more than a dozen charges accusing him of molesting a young girl over 16 months.

In an unrelated case, 37-year-old Kimberly Duthie of Greenville is under indictment for allegedly inappropriately touching and otherwise sexually assaulting a now 9-year-old boy for more than three years.

The indictments against Avery and Duthie are among those handed up this week by the June term of the Hillsborough County Superior Court-North grand jury.

The grand jury handed up some 15 indictments against Avery, 56, of Amherst.

One of them is on the charge of aggravated felonious sexual assault – pattern sexual assault, accusing him of engaging in a pattern of sexual assaults of a girl under age 13 between Nov. 1 and Feb. 28, in Amherst.

The other 14 indictments are all on the charge of aggravated felonious sexual assault, which are special felonies each punishable by up to 30 years in State Prison.

They accuse Avery of committing AFSA twice in November, twice in December, and 10 times in February.

According to a police log entry, Avery was arrested at about 10 a.m. March 14.

He was booked and later released on $25,000 personal recognizance bail pending arraignment, which was scheduled for March 29.

Meanwhile, two of the four indictments returned against Duthie are for pattern sexual assault, which is classified a special felony that accuses the defendant of committing sexual assault-related offenses during a period of time that is more than two months, but less than five years.

One of them accuses Duthie of “rubbing and squeezing” the boy’s penis on more than one occasion between Sept. 1, 2015 and March 6, 2017, in Greenville.

The second one alleges she committed the offense more than once between Oct. 1, 2013 and March 6, 2017, in both Greenville and Greenfield.

The other two indictments are on the charges of aggravated felonious sexual assault – victim under age 13, a special felony, and felonious sexual assault – sexual contact, a Class B felony. The accusations are similar to those in the pattern sexual assault indictments.
