User Agreement

Overview

By using the Telegraph Online Web site, you hereby agree to be bound by all of the terms and conditions contained in this User Agreement ("Agreement"). Ogden Newspapers of New Hampshire LLC reserves the right at its discretion to change the terms of this Agreement and will provide notice of any such changes by online posting. Your continued use of the Telegraph Online Web site after the posting of any notice of change in terms shall constitute your agreement to be bound by any such changes.


Definitions

Telegraph Online includes all Web sites owned and operated by the Ogden Newspapers of New Hampshire LLC including Get Classifieds and Parenting New Hampshire.


Membership and Registration

Certain areas of the Telegraph Online may require registration or may otherwise ask you to provide information to participate in certain features or access certain content. The decision to provide this information is purely optional, however if you elect not to provide such information, you may not be able to access certain content or features or participate in various areas of the site(s). When you register or become a member of the site(s) or provide information to us in any other manner, you agree to provide only true, accurate, current and complete information on all registration pages. Using a name other than your own legal name is prohibited. You agree that we may use the information you provide to us according to the Privacy Policy on the site(s).

If you become a member of the site(s), you agree to accept responsibility for all activities that occur under your account or password, and agree you will not sell, transfer or assign your membership or any associated rights therein. You are responsible for maintaining the confidentiality of your password and for restricting access to your computer so that others may not access the site(s) using your name in whole or in part.


Outside Pages

From time to time, we will occasionally provide links to Web pages which exist outside of our control. These links are intended to enhance our readers' understanding of certain stories and/or issues. We have no control over either the content or the availability of these sites and therefore assume no liability arising out of their use or attempted use.


Limitations On Use

Copyright and Restrictions. All information displayed, transmitted or carried on the Telegraph Online Web site including, but not limited to, directories, guides, news articles, opinions, reviews, text, photographs, images, illustrations, audio clips, video clips, trademarks, service marks and the like (collectively, the "Content") is protected by copyright and other intellectual property laws. The Content is owned by the Telegraph, its affiliates or third party licensors. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display, or in any way commercially exploit any of the Content or infringe upon trademarks or service marks contained in such Content. You agree to abide by all copyright notices and restrictions attached to any Content accessed through the Telegraph Online Web site, not to alter the Content in any way, and not to alter or remove any trademark, copyright or any other notice from copies of the Content.


Permitted Use

You may make a single copy of the Content displayed on the Telegraph Online Web site for personal, noncommercial use only, provided that you do not remove any trademark, copyright and any other notice contained in such Content. You shall not archive or retain any Content in any form without written permission from the Telegraph. You may not distribute (including via e-mail or the Internet), or otherwise make available, copies to others, whether or not for payment or other consideration, without written permission from the Telegraph. Changes in Service

Member Submissions and Community Sites

You agree not to use the Telegraph Online Web site, or permit your account to be used, to send or submit for public posting, distribute or otherwise publish through the Telegraph Online Web site, any content (textual, graphical or otherwise) which (A) is libelous, invasive of privacy, abusive, obscene, profane, defamatory, inaccurate, sexually explicit, inappropriate for general distribution, threatening or otherwise illegal, (B) promotes, suggests or encourages illegal acts, (C) contains any solicitation of funds or unsolicited "junk" mail, (D) violates any copyright, trademark or other intellectual property laws, including but not limited to the re-posting of any material from other sources, (E) contains any advertisement of goods or services, except in areas specifically designated for such purpose, or (F) violates any other laws of any jurisdiction in which the Telegraph Online Web site is accessed.

Any violation of the foregoing prohibitions may result in the termination of your account and may be referred to law enforcement authorities. The Telegraph is not responsible for any content submitted by you, through your user account or by other users, and is not responsible for screening, editing or monitoring such material. Nevertheless, the Telegraph reserves the right (but is not obligated) to delete messages or remove users that it, in its sole discretion, deems to be in violation of the terms of this Agreement or otherwise unacceptable. You assume full responsibility for the content of all messages posted by you or through your account.

You agree to indemnify, defend and hold the Telegraph and all of its officers, directors, shareholders, employees, agents, licensors, contractors and affiliates harmless from any claims (including, but not limited to, claims for defamation, trade disparagement, privacy and intellectual property infringement) and damages (including attorneys' fees) arising from any submissions by you or through your account.


Sharing on our site

We encourage our users to share and upload photos, videos, text, and other information on our web sites. When you post text, photos or any information onto our sites, you are responsible for the content, agree to not hold The Telegraph or its affiliates responsible or liable for any content from other users, and hereby grant The Telegraph a perpetual license to use, redact, republish, copy, perform and distribute your content and screen name, including any intellectual property contained therein, in any manner without any compensation to or further approval from you. You agree to not post defamatory, abusive or otherwise offensive materials, not infringe upon or violate intellectual property rights, copyrights, right to privacy laws, or act threatening or harmful toward any group or individual. You also agree to not post inaccurate or misleading information, illegal material, or any content containing software viruses, advertising or spam messaging. We may further use your name, likeness, publicly accessible biographical data and any other information in connection with such use of the content. You acknowledge that our use of your content may include licensing such content to third parties and/or using such content for advertising purposes. In no event shall we be required to seek your approval or provide you with any payment for such uses. By submitting your content, you agree that further content sharing does not require permission of a third party in order to use the content as described in this User Agreement. The Telegraph is under no obligation to screen or monitor content, but may review content from time to time at its sole discretion to determine compliance with this User Agreement. The Telegraph will make, at its sole discretion, determinations as to what materials are appropriate. We may add, edit or remove any content at any time without notice. If you object to the possibility of coming into contact with content that may be offensive, you reserve the right to not user our site(s). If you notice any unacceptable behavior by any user, please report it to onlineeditor@nashuatelegraph.com
